ScanHaz Affiliate Program

By registering for or participating in the Program, you ("Affiliate", "you") agree to be legally bound by these Terms and Conditions ("Agreement"). If you do not agree, you must not participate in the Program.

To participate you must:

• Be at least 18 years of age
• Provide accurate and complete registration details
• Not be located in a jurisdiction where participation is prohibited by law

We reserve the right to approve or reject any application at our sole discretion, without obligation to provide reasons.

You are an independent contractor. You are not an employee, agent, partner, or joint venturer of the Company. You have no authority to bind the Company, enter into agreements on its behalf, or make representations beyond officially approved materials.

Each Affiliate receives a unique referral link or code. Referrals are tracked via cookies, account attribution systems, or other technical means at our discretion.

Attribution Rule: The last valid referral link used prior to a confirmed purchase determines attribution.

Self-referrals are strictly prohibited. Creating accounts to generate commissions for yourself — directly or through proxies — will result in immediate termination and forfeiture of all commissions.

We do not guarantee tracking accuracy in all circumstances, including cases of cookie blocking, VPN usage, browser privacy modes, or third-party interference.

5.1 Tiered Lifetime Commission

Affiliates earn recurring monthly commissions based on the cumulative number of paying customers successfully referred:

• Commission applies only to confirmed paying customers — free trials and non-converting sign-ups do not count
• The commission rate is locked at the time each individual customer converts to a paying subscription
• Commission rates are not retroactively adjusted
• "Lifetime" means for as long as the referred customer maintains an active paid subscription with the Company

5.3 Commission Basis

Commission is calculated on net revenue received by the Company, excluding VAT and applicable sales taxes, refunds, chargebacks, and any discounts or promotional credits applied.

• Commissions are calculated and paid monthly in arrears
• Minimum payout threshold: €50. Amounts below this threshold roll over to the following month
• Payment methods available: Stripe, PayPal, or Bank Transfer (as selected during registration)
• The referred customer must remain active beyond any applicable refund or chargeback window before commission is confirmed
• We reserve the right to delay or withhold payment pending fraud review or investigation
• Affiliates are responsible for providing accurate and current payment details. We are not liable for failed or misdirected payments due to incorrect information

We reserve the right to reverse or clawback any commission paid or accrued if:

• The referred customer cancels or requests a refund within 30 days of their initial subscription
• A chargeback is raised against the referred customer's payment
• The referral is found to be fraudulent or in breach of these Terms

Subscription pricing may vary by country and is determined by internal systems, market conditions, and AI-assisted pricing models at our sole discretion.

Affiliates have no authority to set, negotiate, or modify final pricing. Affiliates must not misrepresent pricing, offer unauthorised discounts, or make price-related guarantees to prospective customers.

You may promote ScanHaz using content generated via our platform or your own independently created materials, subject to the following restrictions. You must not:

• Make false, misleading, or exaggerated claims about ScanHaz or its capabilities
• Engage in spam — including unsolicited bulk email, messaging, or comment spam
• Use paid search advertising targeting our brand name or trademarks without prior written consent
• Impersonate the Company or create materials that could be mistaken for official ScanHaz communications
• Promote ScanHaz on platforms that permit or promote illegal, adult, or harmful content

All marketing activities must comply with applicable advertising laws and the policies of any platform used (including Meta, Google, LinkedIn, and TikTok).

We may provide AI-powered tools within your affiliate account for content and marketing assistance. You acknowledge and agree that:

• You are solely responsible for all content you publish or distribute, including AI-generated content
• We make no warranties regarding the accuracy, legality, or fitness for purpose of AI-generated outputs
• We are not liable for any claims, damages, or complaints arising from your use or publication of AI-generated content

The following are strictly prohibited and will result in immediate termination and forfeiture of all accrued commissions:

• Self-referrals (directly or through associates, family members, or proxies)
• Fraudulent transactions or manipulation of referral tracking systems
• Use of stolen, fake, or third-party payment methods
• Incentivised sign-ups offering cash-back, rebates, or third-party incentives (unless explicitly approved in writing)
• Abuse of regional pricing (including VPN manipulation, false billing address, or misrepresentation of location)
• Trademark or brand impersonation
• Bulk or automated account creation
• Any activity designed to artificially inflate commission counts or earnings

We reserve the right to investigate any activity suspected of violating these Terms. Upon investigation, we may take any or all of the following actions:

• Suspend or permanently terminate the affiliate account
• Reverse commissions previously credited or paid
• Withhold pending payouts
• Report fraudulent activity to relevant authorities

Either party may terminate this Agreement at any time with or without cause. Upon termination:

• Affiliate referral links will be deactivated
• No further commissions will accrue
• In cases of termination for breach, all unpaid commissions will be forfeited
• In cases of termination without breach, accrued commissions for completed periods will be paid out subject to the minimum payout threshold

We may update these Terms at any time. Changes will be communicated via the affiliate dashboard and take effect immediately unless otherwise stated. Continued participation in the Program following any update constitutes acceptance of the revised Terms.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, or punitive damages, including loss of income, loss of profit, or tracking and attribution errors.

Our total aggregate liability under this Agreement is limited to the total commissions paid to you in the three (3) months immediately preceding the event giving rise to the claim.

We make no representations or guarantees regarding the level of income you may earn through the Program. Earnings depend entirely on your individual efforts, audience, and market conditions. Any income examples or estimates provided are illustrative only.

All ScanHaz trademarks, logos, brand materials, and intellectual property remain the sole property of the Company. You are granted a limited, non-exclusive, revocable licence to use approved materials solely for the purpose of promoting ScanHaz through the Program. This licence may be revoked at any time.

You agree to comply with the General Data Protection Regulation (GDPR) and all applicable data protection legislation in your jurisdiction. You must not collect, store, or process personal data of prospective customers without appropriate legal basis and consent.

You are solely responsible for declaring all commission income to the appropriate tax authorities in your jurisdiction and for paying any applicable income tax, VAT, or other levies. We may be required by law to withhold tax on payments in certain jurisdictions and will do so where applicable.

This Agreement is governed by the laws of Ireland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Ireland.

This Agreement constitutes the entire agreement between the parties with respect to the Program and supersedes all prior agreements, representations, or understandings, whether written or oral.
